Microsoft Customer Contract*

* This Agreement generally regulates the contractual relationship between Microsoft as the operator of the Azure Platform and Symbioworld GmbH as the provider of services to End Users provided on the Azure Platform. However, selected contractual terms also have a direct effect on end customers because the services offered by Symbioworld GmbH cannot conflict with the underlying contractual terms of the Azure Platform. In addition, the end customer can directly use the services of the Azure Platform made available by Microsoft on the Azure Platform in general (i.e. without direct connection to the services provided by Symbioworld GmbH). Such contractual terms are, for example, terms relating to copyright, free products and distributable code or termination for regulatory reasons.

* The European Union (EU) General Data Protection Regulation (GDPR) governs the transfer of Customer Personal Data outside the European Economic Area (EEA – which includes all EU countries plus Iceland, Liechtenstein, and Norway). Microsoft provides its Services to Customers in accordance with the EU Standard Contractual Clauses (SCC) (also referred to as the EU Model Clauses), which provide specific safeguards for the transfer of personal data for services included in the Services. These EU Standard Contractual Clauses are used in agreements between service providers (e.g. Microsoft) and their customers – as described in the Data Protection Addendum (DPA) to the Microsoft Online Services Terms (OST) – to ensure that any personal data leaving the EEA is transferred in compliance with the GDPR. For such a transfer of personal data, Symbioworld GmbH has conducted a Transfer Impact Assessment (TIA) and provided it here.

Symbioworld GmbH is itself ISO 27001 certified and always selects the appropriate data protection & security options from the Microsoft Trust Center for Symbio for its customers.
